These Terms of Service (“Terms”) govern the use of services provided by Ember Syndicate, including but not limited to web hosting, domain registration, website design and development, network installation and management, smart home and security device installation, and specialized lighting design (collectively, the “Services”). By engaging with our Services, the Client (“You” or “Customer”) agrees to the following terms and conditions.
1.1. We provide a wide range of technology and infrastructure services including:
Web hosting and domain registration
Website design and development
Network installation, management, and monitoring
Security camera installation and configuration
Smart home equipment installation and integration
Specialized lighting design and implementation
1.2. Services are provided on a best-effort basis and may be subject to third-party limitations (registrars, ISPs, equipment manufacturers, etc.).
2.1. Standard Fees
Web Hosting Packages: As outlined in your plan or proposal.
Network Installation & Management: Quoted per project or billed hourly.
Smart Home & Security Installation: Quoted per project.
Lighting Design: Quoted per project.
2.2. Additional Fees
Late Payment Fee: $25 per overdue invoice.
Service Pause Fee: $15 to temporarily suspend hosting or related services.
Domain Registration/Renewal Fees: Charged at current ICANN and registrar rates. These do not fall under this fee schedule.
Rude Customer Fee: $100 may be applied for abusive, hostile, or unprofessional behavior toward staff.
Reactivation Fee: $50 for reactivating suspended accounts.
Data Recovery Fee: $75 per incident, plus labor if applicable.
Onsite Service Call Fee: $100 minimum, plus hourly labor and travel expenses.
Emergency Support Fee: $150/hour for urgent after-hours support.
Custom Development or Configuration Fee: $125/hour unless otherwise quoted.
Chargeback/Dispute Fee: $35 per incident.
2.3. All fees are subject to applicable taxes.
2.4. Invoices are due upon receipt unless otherwise specified. Accounts more than 15 days overdue may be suspended. Accounts over 30 days overdue may be terminated, with data permanently deleted.
Maintain accurate contact and billing information.
Ensure compliance with all applicable laws when using our Services.
Not use Services for illegal, abusive, or prohibited purposes (including spamming, hosting malicious content, or unlawful surveillance).
Provide access to premises, networks, or equipment when required for installations or service.
We do not guarantee uninterrupted or error-free service but will use reasonable efforts to maintain uptime and quality.
Domain availability and registration are subject to ICANN and registrar rules, which are beyond our control.
Smart home and security installations may require third-party platforms or updates; ongoing compatibility cannot be guaranteed.
We are not liable for damages, loss of revenue, loss of data, or service interruptions beyond the fees paid by the customer for the affected period.
Customer agrees to indemnify and hold harmless [Your Company Name] against claims resulting from misuse of Services.
Either party may terminate Services with written notice.
We reserve the right to suspend or terminate Services immediately for nonpayment, abuse, violation of law, or breach of these Terms.
We may update these Terms at any time. Continued use of Services after notice of changes constitutes acceptance.
These Terms shall be governed by the laws of the state of Missouri, without regard to conflict of law principles.
